Child Custody Modification

Often times people forget, but in order to modify child custody, you must prove a material and substantial change of circumstances warranting the modification. Further, the Court will expect you to show how without such modification, your child's best interests are affected adversely. So, for example you worked fifty hours a week and now due to economic reasons, you are actually at work thirty-nine hours a week. This might be good circumstances to seek more time with your children and even perhaps a modification of the child support, if the loss in income warrants. However, you must prove to the Court that your child is adversely effected by the current custody arrangement and how your child or children's best interests will be enhanced if the Court changes the custody plan.
